NEW FEDERAL LAWS EFFECTIVE JANUARY 2012

Federal Motor Carrier Safety Administration Restricts

the Use of Hand-held Mobile Telephones By Drivers of

Commercial Motor Vehicles

Effective January 3, 2012

The ban prevents commercial motor vehicle drivers from holding, dialing or reaching for hand-held cell phones, including phones with the push-to-talk function. School bus drivers and those driving vehicles designed to carry 9-15 passengers are included. The ban applies when the vehicle is in operation on the highway, when temporarily stopped on the highway for traffic, or when waiting at a stoplight, stop sign or other traffic control device. Hand held cell phone use is only permitted if the vehicle is stopped in an area safe for parking a CMV or to communicate with law enforcement or other emergency services to report emergencies.

Hands-free use of devices with either a wired or wireless earpiece, or the use of the speakerphone function, is permitted.

Drivers can be fined up to $2,750 and truck owners up to $11,000. Visit the FMCSA for answers to Frequently Asked Questions and the Final Rule on this law.



New Medical Certification Requirements for CDL

Holders

Effective January 30, 2012

State driver's license agencies will be adding medical certification status and information on your medical examiner's certificate to your Commercial Driver's License record.

Starting January 30, 2012 all CDL holders must provide driver's license agencies with their medical information. Click here for more information.
